Monetary Compensation for the Unused Annual Leave

Replacing the annual leave with monetary compensation shall not be allowed. Where due to rescission of the employment contract the annual leave cannot be granted to the employee, who was granted the right to annual leave, or where the employee does not want the leave to be granted, he or she shall be paid monetary compensation.

The monetary compensation for the unused annual leave shall be paid when the employment contract is rescinded. The amount of compensation shall be determined in accordance with the number of days of the unused annual leave to be granted for the given period. If the employee has not been granted annual leave for a period longer than one year, the compensation shall be paid for all the unused annual leaves.
