Mediation is now mandatory in Armenia for resolving certain family disputes.
These include:
- Divorce
- Determining a child’s place of residence
- Recovery of alimony
- Division of common property
- Issues related to communication with a child, their upbringing and education
- Establishing child visitation arrangements
- Modification or termination of a marriage contract
The Ministry of Justice justifies this by stating that mediation can be an effective alternative for resolving various disputes. After being signed and approved, a mediation agreement has the same legal force as a court decision. If one of the parties fails to comply with the terms of the agreement, it is possible to apply for enforcement.
