“We must not make mediation just a formality on the way to court”: the positive aspects, risks, and opportunities of making mediation mandatory for certain family cases

Mediation is now mandatory in Armenia for resolving certain family disputes.

These include:

  • Divorce
  • Determining a child’s place of residence
  • Recovery of alimony
  • Division of common property
  • Issues related to communication with a child, their upbringing and education
  • Establishing child visitation arrangements
  • Modification or termination of a marriage contract

The Ministry of Justice justifies this by stating that mediation can be an effective alternative for resolving various disputes. After being signed and approved, a mediation agreement has the same legal force as a court decision. If one of the parties fails to comply with the terms of the agreement, it is possible to apply for enforcement.
