No new proceeding will be instituted on life convict Mher Yenokyan’s Case. Such was today’s verdict of the Court.
The regular court session on the case Mher Yenokyan v. Prosecutor General’s Office was held in a half dilapidated hall of events of “Nubarashen” Penitentiary (Presiding Judge Mnatsakan Martirosyan). To remind you, at the end of the last session, the accused filed a motion to the court with request to assign advocate Levon Baghdasaryan to defend his interests.
Today he stated, “There is one problem to be solved and it has two options for solution. 20 years ago they decided that ‘you Mher have to die,’ and their decision is subject to change. The crime was at home in daytime. How many such cases exist when the deliberated crimes were carried out in similar conditions? I do not know that. Instead, how many cases exist when the domestic dispute turned into a murder, I know a lot. Mher is tried without corresponding expertise, based on the evidence provided by the criminal participants. If we compare his later statements, we can see that they are a better stated, contradict the preliminary testimonies. The experts write that his testimony completely contradict to each other,” added the advocate.
Mher Yenokyan’s second advocate Seyran Grigoryan mentioned that the experts deny the fact of committing the murder by the accused. “Yenokyan’s fingerprints are missing. There are no certain studies. Isn’t this enough for initiating a new proceeding? We avoid using the expression ‘miscarriage of justice’. Initiate a proceeding, examine and consider and let Yenokyan’s case be the first!” said the advocate.
Yenokyan expressed wish that the prosecutor Levon Charkhifalakyan read his request to the Prosecutor General, and added that he was ready to provide additional testimony, however his application simply remains unanswered. “Point evidence that confirms my fault and I will apologize and go my ward, and stay there for life,” said the prisoner.
The prosecutor Charkhifalakyan said that the application has been received but not read. It is now at the appropriate persons.
At the end Yenokyan added that he had applied to the relevant authorities asking them to guarantee his and his family’s safety, in which case he will make very important statement, but the application was left unanswered.
The court left to the retirement room to take a decision. Returning, Judge Mnatsakan Martirosyan completely declined the motion on initiating a new criminal proceeding. This decision caused the anger of the citizens in the court room, who addressed offensive expressions to the prosecutor.
