“Unified practice is not being formed”: The procedure for initiating disciplinary proceedings against judges is unclear
The institute of disciplinary liability for judges, being one of the most important links of judicial power, is constantly at the center of attention of the professional community.
During 2023-2024, monitoring regarding disciplinary proceedings has been carried out by the “Rights Protection Without Borders” NGO.
Hasmik Harutyunyan, the NGO’s legal expert, told us in an interview that during the monitoring conducted, a number of problems were recorded regarding 12 cases, which are mainly related to violations of procedural deadlines.
According to Harutyunyan, if judges have problems with observing procedural deadlines, the solution should be sought in the judicial system. In this regard, for example, it is unclear how the bodies initiating proceedings, particularly the Ministry of Justice, choose the judge who has allowed violations of those deadlines.
