What is Terrorism?

Terrorism is one of the most dangerous crimes committed against public security.

According to the Criminal Code of the Republic of Armenia, terrorism is such an activity, which is directed to the death of a civilian or a person not participating actively in military activities during infliction of heavy bodily damages or to their threat if such an action is committed with the purpose of intimidation of the population by its nature or accepting the decision of a state body or an international organization or an official person or influencing the implementation of the action or refraining from them, as well as any action which is considered as a terror foreseen by international contracts of the Republic of Armenia, except for actions envisaged in Article 218 of Criminal Code, is punished with imprisonment for the term of 5 to 10 years with confiscation of property or without it.

The same action committed by a group of persons with prior agreement is punished with imprisonment for the term of 8 to 12 years with confiscation of property or without it.

Notably, the envisaged actions that

1) were committed by an organized group;

2) caused death by negligence or other grave consequences, is punished with imprisonment for the term of 10 years to 15 years with confiscation of property or without it.

It should be mentioned that a person who participated in terrorism is exempted from criminal liability if he informed the authorities on time, or otherwise, contributed to the prevention of terror act, and if his actions do not contain the elements of other crime.

Authority bodies are those state bodies, which can take actions to prevent terrorism or can keep competent bodies informed about the crimes.

We should inform that a person, who informed about the terrorism on time or contributed to the prevention of terror act, is exempted from criminal liability if his actions do not contain the elements of other crime. But the person, whose actions contain the elements of other crime, is subject to criminal liability only for them, liability envisaged for terror is excluded in this case.

If the actions of the person do not result in the prevention of terror act, he is not exempted from criminal liability for terror act. But in this case the actions of the person directed towards the prevention of the terrorism are taken into account as a mitigating circumstance.
