The terms of detention of Khacahatur Kachatryan, judge of the Court of General Jurisdiction of Lori marz was extended for two months. The judge’s advocate Karen Tumanyan told to Iravaban.net that the Court of General Jurisdiction of Lori Marz had taken such decision on 18 February.
“We have submitted the motion with our objections on unlawfulness of the decision, because there were no grounds for detention from the very beginning, consequently the detention could not be extended. We shall appeal this decision and then apply to cassation. I should note that it is the decision of the Court of Appeal on the first arrest is not yet returned or it has not been accepted into the procedure. After the position of the Cassation Court we shall send the case to the European Court,” said the advocate.
The advocate also provided his evaluation on the video circulated by the NSS after the arrest of the judge. He argued that the edited version of the video was circulated. To our question whether important facts of the case were left out of the video, the advocate answered, “Yes, but they are not currently subject to publication.”
According to Mr. Tumanyan, the arrested judge had debts to different banks, “A total of around 9,000 US dollars. The data that is presented and which state that the profits have increased as well as the income, are not true, because the debts to the banks presented by Khachatur Khacahtryan are not yet recovered, and the obligations are not met,” he said.
According to information of the NSS Khachatur Khachatryan had requested and received a bribe of 20.000USD for making a favorable decision on the civil case of a businessman in his procedure. The NSS of the RA has initiated a criminal case under the requirements of Clause 2 and 3 of Part 4 of Article 311 of the Criminal Code of the RA. On 29 December, Court of General Jurisdiction of Arabkir and Kanaker-Zeytun administrative district of Yerevan city has detained the judge for two months. “The Judge had not testified or said anything yet. He pleaded himself not guilty” defender Karen Tumanyan had informed.
