Yerem Sargsyan, advocate of Davit Khachatryan, who was recognized guilty of Lyuks Stepanyan`s murder, appealed to the court. Mr. Sargsyan informed Iravaban.net that there were several justifications for the appeals: “First of all there is the violation of the presumption of innocence, violation of fair trial and the fact that courts are not sufficiently independent. The last case was the infringement of the law by the Criminal Court of Appeals when the victim Hrachya Sargsyan who lost his memory, informed that he remembered new details and conveyed several facts that were quite important for the case. Through our solicitation the victim was not questioned and this evidence was overlooked”, said the advocate and added that in addition to this the process of the evidence evaluation was falsefully carried out. “The crime was not set. Davit Khachatryan did not have any intention on killing Lyuks Stepanyan, but there was just a violation of the rules of arms usage”, and based on this defense asks the Court of Appeals to overturn the judicial act against Davit Khachatryan.
