Alexander Kochubaev, the defender of the former Chairman of the Urban Development Committee, Vahagn Vermishyan, referred to the decision of the Constitutional Court of 27 February regarding the Part 7 of Article 7 of the Labor Code.

In an interview with Iravaban.net, the lawyer mentioned that when Vermishyan was dismissed from his position back in 2019, his dismissal was appealed to the Administrative Court, the First Instance rejected it, however, to their surprise, the Court of Appeals, going beyond the scope of the submitted appeal, pointed out one basis and satisfied the claim, but that argument, according to the defender, was not raised before the Court of Appeal.

According to Kochubaev, the essence of the problem was who was authorized to release Vahagn Vermishyan from his post, the Prime Minister or the Government, and therefore the reference was made that the Government should have released him, and it was declared invalid on that basis. Within the scope of the cassation appeal brought later, for reasons incomprehensible to the lawyer, the Court of Cassation made a decision to appeal to the Constitutional Court. Regarding the same issue, the Court of Cassation had previously made a decision by which the legal norms had already been interpreted.

Judge Vahe Grigoryan, who was appointed as the rapporteur of the case at the CC, strongly believes that this was done for one purpose. Grigoryan wanted to show greater services to the authorities, because many civil servants, not only Vermishyan, were dismissed on a similar basis.

“In order to understand the problem correctly, one must understand the developments that are happening in the parallel reality, and that is that Vahe Grigoryan wants to be elected as a member of the ECHR, and the Government of Armenia, among other things, will also propose his candidacy, or with this he tried to serve the political power so that his candidacy was also nominated for the position of judge of the European Court”, Alexander Kochubaev said.
