Iravaban.net publishes the scientific article by lawyer Nerses Aghababyan in the Armenian Legal Magazine on the topic “Termination of the director’s powers and the unprincipled judicial practice of the Court of Cassation”.
Nerses Aghababyan, lawyer by profession, graduated from the French University Foundation in Armenia (Bachelor’s Degree: 2009, Master’s Degree: 2011), has a Master’s Degree from University College London (2012), and has been a member of the RA Chamber of Advocates since 2016. He has been practicing law in Armenia since 2009, authored 5 articles and one book, “Labor Law: Judicial Practice”, the 3rd edition of the book was published in 2021.
The article presents problematic issues regarding the status of the Executive Body (Director) in Armenian law:
- Can the director be considered an employee, and to what extent are the norms of labor legislation applicable to him?
- How to interpret the provisions of the laws of the corporate sector relating to the director?
- What are the grounds based on which the contract with the director can be terminated?
The article analyzes the director’s corporate and contractual ties, the conflicting judicial practice of the RA courts regarding the director’s status, and also makes recommendations regarding the possible solution of the existing problems through legislation.
