Today, the Prosecutor’s Office of the Republic of Armenia celebrates the 104th anniversary of the establishment of the Prosecutor’s Office and the Day of the Prosecutor’s Office employee.
Iravaban.net present the system for evaluating the degree of legitimacy of the selection of the incumbent and elected prosecutor generals developed by us, according to the voting results of the National Assembly, on the basis of the following criteria:
a) Degree of participation of deputies in voting,
b) The results of voting “in favor” by deputies,
c) The results of non-participation in the voting of deputies, as well as the “against” and “invalid” votes,
d) Degree of participation in voting by factions.
Thus, according to Article 177 of the RA Constitution, “the Prosecutor General shall be elected by the National Assembly, upon recommendation of the competent standing committee of the National Assembly, by at least three fifths of votes of the total number of Deputies, for a term of six years. The same person may not be elected as Prosecutor General for more than two consecutive terms.
It also establishes that only “A lawyer with higher education, having attained the age of thirty-five, holding citizenship of only the Republic of Armenia, having the right of suffrage, with high professional qualities and at least ten years of professional work experience may be elected as Prosecutor General. The law may prescribe additional requirements for the Prosecutor General.”.
The National Assembly may, in the cases prescribed by law, remove the Prosecutor General from office by at least three fifths of votes of the total number of Deputies.

On 15 September, 2016, the National Assembly of the 5th convocation elected Artur Davtyan to the position of Prosecutor General.
- 2 percent or 103 of the total number of 130 deputies participated in the voting.
- 6 percent or 97 of the total number of 130 deputies voted “for”.
- 3 percent or 3 of the total number of 130 deputies voted “against”.
- 3 percent or 3 votes of the total number of 130 deputies were recognized “invalid”.
- 7 percent or 27 of the total number of 130 deputies did not participate in the voting.
The National Assembly of the 5th convocation included:
- “Republican Party of Armenia” Faction (69 MPs),
- “Prosperous Armenia” Faction (37 MPs),
- “Armenian National Congress” Faction (7 MPs),
- “Country of Law” Faction (6 MPs),
- “Armenian Revolutionary Alliance” Faction (5 MPs),
- “Heritage” Faction (5 MPs).
- 2 MPs were not included in them.
All factions from these political forces participated in the election of the Prosecutor General.
On 15 September, 2022, the National Assembly of the 8th convocation elected Anna Vardapetyan to the position of Prosecutor General.
- 4 percent or 70 of the total number of 107 deputies participated in the voting.
- 4 percent or 70 of the total number of 130 deputies voted “for”.
- 0 percent or 0 of the total number of 130 deputies voted “against”.
- 0 percent or 0 votes of the total number of 130 deputies were recognized “invalid”.
- 6 percent or 37 of the total number of 107 deputies, including the opposition, did not participate in the voting.
The National Assembly of the 8th convocation includes:
- “Civil Contract” Faction (71 MPs),
- “Armenia” Faction (29 MPs),
- “With Honor” Faction (7 MPs).
From these forces, only the “Civil Contract” Faction participated in the election of the Prosecutor General.
Այս ամենից կարելի է եզրահանգել, որ 5-րդ գումարման Ազգային ժողովի կողմից ընտրված գլխավոր դատախազ Արթուր Դավթյանը ընտրության ավելի բարձր լեգիտիմության աստիճան ունի, քան 8-րդ գումարման ԱԺ կողմից ընտրված գլխավոր դատախազ Աննա Վարդապետյանը՝ հաշվի առնելով ԱԺ խմբակցությունների և պատգամավորների կողմից քվեարկության մասնակցության աստիճանն ու պատգամավորների կողմ, դեմ, անվավեր քվեարկության արդյունքները, ինչպես նաև պատգամավորների քվեարկությանը չմասնակցության աստիճանը։
