Article 5 of the “Law on Medical Care and Services of the Population defines human rights in receiving medical care and services”, according to which every person has the right to seek medical help, as well as to receive medical care and services, in order to seek medical help, his health status. , confidentiality of information revealed during examination, diagnosis and treatment, except as provided for by the legislation of the Republic of Armenia.

Article 19 of the same law defines the responsibilities and liability of the providers of medical care and services. “To ensure the confidentiality of the fact of seeking the assistance of a human at the doctor, of information found during the examination, diagnosis and treatment of his/her medical condition, except as provided for by the legislation of the Republic of Armenia.”

In addition to Article 19.3, the obligations of health care providers shall be governed by paragraph 7 of which health care providers are obliged to keep medical confidentiality, except as provided by law.

Article 145 of the Criminal Code provides:

  1. Divulging information on the patient’s illness or the results of medical tests, by the medical personnel, without professional or official need, is punished with a fine in the amount of 200 to 500, or by deprivation of the right to hold certain posts or practice certain activities from 2 to 5 years, or with arrest for the term of 1 to 2 months.
  2. Actions envisaged in part 1 of this Article, if they caused grave consequences by negligence, are punished with imprisonment for up to 4 years, with deprivation of the right to hold certain posts or practice certain activities for up to 3 years or without that.
