Nowadays, when the employers regularly violate the employees’ labor rights including the right for providing annual leave, every employee should be aware of the three important rules that are provided here:
Pursuant to Article 169 of the RA Labor Code:
1. The employer shall pay average salary to the employee for annual leave, which is calculated by multiplying the average daily salary of the employee by the number of days of the leave being granted.
Payments that are larger than those defined by this Code can be defined for the annual leave by the collective agreement or the employment contract or the employer’s legal act, except for the organizations funded from the state and community budget, as well as the Central Bank of the Republic of Armenia.
2. The payment for annual leave shall be made not later than three days before the commencement of annual leave. Where the payment due to the employee is not made in the defined period not by the fault of the employee, annual leave shall be extended by as many days as the payment was delayed, and the payment for the extended period shall be the same as the payment for annual leave.
3. According to Article 166 of this Code, the employee involved in work shall be paid a salary, regardless of the fact that the payment for the annual leave has been made. If the employee subsequently uses the paid, but not used days of the annual leave, the employer shall pay for these days the average salary through the procedure established by this Code.
