The Individual Accused of Committing a Serious Crime Has Escaped. Criminal Case Initiated Against the Officer in Charge of Conducting the Proceeding

The Special Investigation Service of the Republic of Armenia has accomplished the preliminary investigation of the case instituted in accordance with Part 1 of Article 308 of the Criminal Code of the Republic of Armenia with regard to the abuse of official powers by the Chief Investigator of Armavir Investigation Department of the Main Investigation Department of the Police of the Republic of Armenia Gor Gevorgyan on his personal grounds. The criminal case along with the indictment has been handed over to the prosecutor in charge of exercising juridical control for the approval and referral thereof to the court.
The preliminary revealed that Gor Gevorgyan, who gave out independent directions as to the comprehensive, complete and objective examination of the case, who took required decisions and carried out investigation and other juridical acts in compliance with the provisions of the criminal procedure law, as well as an official responsible for lawful and timely fulfillment thereof, under the criminal case reviewed in his proceeding which was instituted with regard to the commission of a disruptive behavior by Samvel H., with the use of a weapon on April 24, 2014, on his personal grounds to maintain his intimate relationship with Samvel H., did not fulfill his official duties to completely detect the crime committed and report to the body in charge of conducting the proceeding upon the putting thereof on the wanted list. In particular, from the first days of the launch of the investigation of the criminal case, he repeatedly had meetings with Samvel H. and his friend accused of committing a disruptive behavior. In the course thereof, Samvel H. confessed the circumstance that he had committed a disruptive behavior and fired with “Toz” gun. He told in detail the motives for the commission of the crime and the acts committed by the participants of the crime. To find out the facts to the case instead of undertaking urgent investigation acts, collecting new evidence, calling Samvel H., to the body conducting a proceeding and organizing operative-search operations through the employees of Armavir Police Department directed at the detection of the gun as a murder weapon, the Chief Investigator Gor Gevorgyan informed Samvel H. in detail about the instructions issued by the prosecutor in charge of exercising a juridical control over the investigation and the evidence obtained. In addition, in order not to detect the crime he persuaded to use a confidential phone number and contact him by the given phone number. During the given time, in order to create a pretext of carrying out activities directed at spotting the whereabouts of Samvel H. and others, on May 5, 2014 he sent formal notices and later decisions about the fact of taking them into custody to Armavir Police Department.
Thereafter, based on the combination of the evidence to the case, on May 22, 2014 after making decisions about involving Samvel H. as a defendant, announcement of search for him and initiating a motion as to the election of an arrest as a measure of restraint, on the same day and the following day, he again had secret meetings with Samvel H., who was already on the wanted list and informed him about the above decisions taken by him.
Samvel H., accused of committing a serious crime as a result of the intentional actions made by Gor Gevorgyan has escaped and the gun used him as a murder weapon has not been detected.

Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
