“We punished more severely”: Sedrak Asatryan on the New Draft Law on Sanctions against the Advocates

“Many people think that this sanction had not be applied against the advocates before, and it is introduced just now, yet it is not so,” Mr. Sedrak Asatryan, Member of Board of the Chamber of Advocates of the RA said in the interview with Iravaban.net on the issue of the new provision of the RA Civil Procedure Code on imposing a fine of 100.000AMD against the advocates.

“Today’s legal regulation was that in case of imposing sanction the court sent the decision to the Chamber of Advocates. The Chamber should initiate a proceeding and the Board should discuss it. The Board examines it and making a reasoned decision. In this case, one of our concerns is that the court may have an emotional outburst at the moment, can be offended, get out of balance and striking the hammer says that a sanction is being applied,” Mr. Asatryan said.

According to Sedrak Asatryan, statistics show that the Chamber punished more severely when it saw a breach, but there had been a lot of cases when the sanction was unfounded. “It turns out that we are developing and moving forward this collegial, balanced institute. When there was the necessity to use such a regulation, we did not do it and now they have introduced and are applying though we have been applying it already and what is more we have that institute.
