The process of intercourse between the arrested and the lawyers is being simplified and opportunities expanded. Today at the Government session, Minister of Justice Arpine Hovhannisyan presented three drafts, which firstly state that the advocates can visit the arrested on non-working days as well.
In addition, they plan to apply the new mechanism, which enables the arrested and the detained to meet with their lawyer and also with the advocate who visit them to undertake their defense.
The next important step concerns to the entrance of the lawyer into the penitentiary without being accompanied by the investigator. According to the draft the advocates could enter the penitentiary institution based on the written authorization provided by the investigator to the administration of the penitentiary.
The solutions offered by drafts enable to secure the arrested to meet with the lawyer not involved in the criminal proceeding on the basis of the self-motion if it is connected for example with the need to receive judicial support in civil, administrative, labor or any other sphere.
According to the Minister, with the adoption of the project the problems that prevent the regular process of the criminal proceeding and restrict the constitutional rights of the arrested person at the same time providing the natural operation process of the penitentiary and protection of public interest during the trial of the criminal case.
The Government approved this draft.
