“The First Instance Court has shown a creative approach with regard of some evidence and reduced the material circumstances, “stated the former head of the Judicial department Misak Martirosyan today in the RA Criminal Court of Appeal.
Notably, on 18 July, Judge of the Court of the First Instance Arshak Vardanyan sentenced announced the verdict on the case of the Former head of the department and 12 employees.. They were accused in of creating a criminal group and plundering 115 million AMD from the State.
The former Head of the department Misak Martirosyan was sentenced to 6 year imprisonment with the property confiscation for about AMD 720.000.
The defense had lodged an appeal, and the investigation of the complaint was continued today under the presiding Judge Karine Ghazaryan.
Defendant Misak Martirosyan stated that the Court of First Instance had fabricated the criminal case. “The court included false evidence in my testimony, specifically the protocol on my and Gegham Grigoryan’s face to face identification, which had not taken place. The Court deliberately presented erroneous and incomplete facts,” he said. Judge Vazgen Rshtuni was displeased with these words, “Respectful attitude towards the court does not refer only to the court of appeal. I ask the same attitude towards the court of first instance,” he urged.
Then Misak Martirosyan referred to the accusation, “First the fact that I was allegedly aware of the names included in the staff list of my service. Continuing the prosecution’s logic, it turns out, in any department of the Judicial department a soap or a toilet paper is stolen, then the department head will be found guilty,” Misak Martirosyan said.
The defendant believes that judgment of acquittal for lack of corpus delicti shall be ruled for him.
Today, Gegham Grigoryan’s defender Tigran Atanesyan and Angin Ghukasyan’s defender Armen Feroyan applied to the court with request to annule the decision of the First Instance Court regarding their clients.
