The Press Service of the RA Human Right Defender’s Office informs that the citizen who had applied to the ombudsman, had informed that she had owned a privatized apartment from 90-s, but after being absent from the country for some years it turned out that the Police had removed her from the registration book without informing her and without her permission.
The State Cadastre Committee informed that the apartment was privatized by Nor Nork Community and disposed to another person as a gift thus depriving her from the property right of the apartment. The police in its turn made a decision on denial to initiate a criminal case on the prepared materials based on the woman’s reports. The decision of denial to initiation a criminal case was appealed to the superior body, but the prosecutor did not meet the complaint as well.
It turned out that the investigator did not undertake measures for to find out the legality the woman’s removal from the registration list, neither they had studied the legal regulations of those days of that period.. The prosecutor in his turn failed to carry out proper supervision of the legality of examination of the case. Ombudsman Karen Andreasyan has made a decision about the fact of violation of human rights. The defender offers the prosecution to take efficient and sufficient measures to excluding such cases, to subject the official to disciplinary punishment and also to discuss the issue of possibility on lifting the decision on the denial to initiate a criminal case.
