Yerevan AAC was involved in the issue of restoration of labor rights of the lecturers of French University Foundation in Armenia since August 2010.
The Court of General Jurisdiction of Arabkir and Qanaqer-Zeytun Administrative Districts of Yerevan by the decision of 11 May 2011 allowed the claim of 12 lecturers of French University Foundation in Armenia, who had been dismissed from office. According to the court decision the lecturers shall be restored in their previous positions. At the same time according the ruling the university is bound to pay the salary for the whole period of forced stoppage, as well as pay the whole non paid sum for the vocations of the period of 2004-2009 time: total 4.154.058 AMD. In addition to this sum the University shall fulfill its tax obligations to the state. 82.440 AMD shall be exacted from the University for the benefit of the applicants as court expenses. It is due to mention the fact that the Court considered that the orders of Administrative-Financial Director or Secretary General of the University on extension of the labor contracts shall not have legal effect as they have not such authorities.
The Court also stated that “…the labor contracts were annulled without any legal grounds…” Actually the Court considered that the labor agreements signed with the dismissed lecturers were indefinite-term contracts.
It is due to mention that Mrs. Anahit Hakobyan, advocate of Yerevan AAC operated by the Armenian Young Lawyers Association represented the rights and interests of the applicants in the court.
On 12 May 2011, Mr. Marat Atovmyan, Head of Yerevan AAC and Mrs. Anahit Hakobyan and two ex-lecturers of the French university Foundation in Armenia attended a press conference in “Armat” Press Club. They introduced the essence of the problem and the efforts aimed at protection of the rights of lecturers as well as informed about the activities of AACs to the attention of representatives from around 15 mass media means.
