The RA General Prosecutor’s Office continues to present the indicators of the anti-corruption criminal law struggle carried out in 2019. According to the latter, in 2019, a total of 1,264 people were prosecuted for corruption cases investigated by the RA preliminary investigation bodies, which is 31.6% more than in 2018 (960 persons). During the proceedings, the criminal prosecution against 375 persons was terminated, of which 109 or 29% on the grounds of justification, 266 or 71% on the grounds of non-justification. Moreover, the number of the latter in 2018 increased by 13.2% compared to 2018.
It should be noted that criminal prosecution against persons has been terminated on the grounds of unjustified detention, as a rule, due to the expiration of the statute of limitations or the application of an amnesty act. And the increase in these figures is due to the restoration of the damage caused to the state or communities within the framework of the regulations of the Criminal Procedure Code, the criminal policy of encouraging support for full disclosure of crimes and applying a more lenient criminal policy towards those who commit minor crimes for the first time.
In 2019, compared to the 1,073 or 81% (819) 31% of those prosecuted, in 2018, a decision to involve as defendants was made of which 1018 were charged. This figure shows that lawsuit was not filed only 5% of those involved as defendants and they were not brought to the body conducting the proceedings during the year, which, by the way, is almost twice less than in 2018.
During the reporting year, the number of arrests decreased by 18 or 15-9 percent (2019 – 95 people – 113 people in 2018). Under these conditions, the number of people released from detention has decreased by 40-5%, which proves that in 2019 the number of unjustified arrests has significantly decreased.
There has also been a steady practice of applying detention as a measure of restraint in corruption cases, as the share of detainees in the total number of defendants has significantly decreased. In particular, in 2019 out of 1,018 defendants, 98 or 9.6 percent were remanded in custody, while in 1018, 90 or 12 percent of the 746 defendants. Against the background of this decrease, 22 or 66-6% less defendants have been released from detention, which proves that the motions of the courts to choose detention as a measure of restraint or to extend its terms were more well-founded and justified.
530 of those prosecuted for corruption in 2019, were officials and civil servants, which compared with 2018 is more by 60 persons or 12.8 percent. According to the positions and spheres of activity, of the prosecuted the classification is as follows:
