The recommended Regulation is unacceptable: the Chamber of Advocates is against the Draft Law presented by the Deputies

RA Law on Amending the Civil Procedure Code of the Republic of Armenia, Proposed by the Draft Law of the Republic of Armenia on the Amendment to the Civil Procedure Code of the Republic of Armenia, by addition to Article 52 Part 2with Clause 4, expanding the scope of persons entitled to provide representation in court. In particular, it is proposed to grant such a right to any capable citizen with higher legal education who has at least five years of professional experience.

The Chamber of Advocates has issued a statement saying:

“The justification for the proposed amendment was the need to ensure the right to effective judicial protection of the individual and to extend the scope of that right.

The Government of the Republic of Armenia has provided a negative opinion on this project.

The Chamber of Advocates finds that the proposed regulation is unacceptable and finds that it will not serve the above purpose, but just the opposite; it will lead to a decrease in the quality of legal assistance.

The Chamber of Advocates submits its position on this draft to the Standing Committee on State and Legal Affairs.
