At the Parliamentary Hearings in the fact of the brutal murder in Gyumri the RA Prosecutor General Gevorg Kostanyan answered to the questions of the MP Nikol Pashinyan who asked, “Were the Russian Law enforcement authorities obliged to inform the RA law enforcement bodies according to the agreement? If they were then had the informed about Permyakov or not? Regardless of the outcome of the preliminary investigation, can you can specify an agreement, which provides opportunity to the Russian law enforcement authorities to take the arrested person to the Russian military base. And the next question: we saw that the armed Russian military men were carrying out some operations in the territory of the city. Which agreement provides them such authority and finally which court shall consider this case?”
Speaking about the trial, Gevorg Kostanyan said that according to the Agreement between the RA and RF regulating the legal issues referring the Russian Military Base the parties shall discuss the proceedings of the exchange of criminal case when they reach that stage. “We shall discuss the issue of exchange of the proceedings when we have all the circumstances. This is not the issue to discuss in this stage yet, and it is difficult to answer at this moment. Criminal actions are still carried out in both investigative proceedings. We shall discuss them as soon as they are completed.”
With regard to the issue about the operations carried out by the Russian military me Mr. Kostanyan said that in such the cases the Law authorities of the Russian Military base participate in the criminal procedure, operative intelligent and investigative activities on the consent of the RA Law Authorities.
As for the operations of the RA border guards, he said that the RF law authorities had to inform about Permyakov’s arrest de jure to the RA Law Authorities. Referring the surrender of the criminal the Prosecutor General said, “According to our legislation, the violator of the border must be surrendered to the RA Law Authorities. The question who had or had not handed over will be clarified in the framework of the criminal case.”
