Despite the fact that the “Law on Mediation” has been in effect since 2015, under which the Self-Regulatory Organization of Mediators was established as a coordinating body for mediators, it has not been actively functioning.

In conversation with Iravaban.net, the president of the Self-Regulatory Organization of Mediators, Gayane Demirchyan, stated that it will coordinate issues related to mediators’ conduct and try to solve problems aimed at the development of the institute.

Since 2022, around 80 mediators have been licensed, and at the beginning of 2024, elections were held for a new body of mediators, including the council and president.

“At this stage, it is very important that the transition be smooth. The state has set a goal to ease and unburden the courts, and in this regard, the Self-Regulatory Organization of Mediators has much to do, especially in terms of developing codes of conduct, so that parties who will apply to a mediator are guaranteed that their disputes are resolved by an impartial third party mediator, and even if the mediator violates certain rules during this process, they are guaranteed who to appeal to, what procedures can be applied against the mediator,” said Demirchyan.

Speaking about the problems, Demirchyan noted that there is currently an awareness issue, and several training courses are being organized.

The other most important problem is the lack of a separate space designated for the organization: “We think the state will take certain steps in this direction, since the creation of the institute is being implemented within the framework of state programs, and from this perspective, the Self-Regulatory Organization of Mediators should have a certain space where all mediators will gather and discuss existing problems.”

She notes that as a result of discussions, they have concluded that the Self-Regulatory Organization of Mediators should be called the Chamber of Mediators, and the issue of naming needs to receive the approval of the general council.
