A.A. fell down from the height of 4meters and 60 centimeters during contractual service in the Army. This caused brain injury. The Social Security Service of the Republic of Armenia Ministry of Defense assigned him a monthly pension of 35.000 AMD, with reasoning that the incident occurred when the soldier was doing work out of his duty. The citizen’s father did not agree with such decision and the size of the assigned pension. He applied to different instances yet with no result. It is due to mention that the only reason for falling down was omission of the command, as the incident took place because there were no banisters on the staircase, and in addition the incident took place when the soldier was carrying out his responsibilities.
On 17.02.2011 the irritated father of the soldier applied to the Advocacy and Assistance center of Aragatsotn marz of the RA. The lawyers of the Center studied the case and considered that the citizen’s claim was grounded and immediately undertook the corresponding actions. In particular the AAC applied to the Social Security Service of the Republic of Armenia Ministry of Defense with request to raise the pension.
After the denial of the request the AAC applied to the Head of Legal Department the Republic of Armenia Ministry of Defense. The latter promised to fulfill the request yet failed to keep his promise.
Before the achieving definite results the beneficiary changed the place of his residence, and went to live in Aparan city. Then Aparan AARC took the case. The AARC lawyer filed a claim to the Court of General Jurisdiction of Avan and Nork Marsh Community against the Republic of Armenia Ministry of Defense with request of reparation.
Eventually after more than a year’s consistent work of the AAC aimed to achieve favorable solution of the citizen’s case gave its results. In September 2011, the beneficiary and the Republic of Armenia Ministry of Defense signed a conciliation agreement in the Court of General Jurisdiction of Avan and Nork Marsh Community. In result of this agreement the beneficiary’s pension was raised for 10000 AMD.
The citizen is very grateful to Ashtarak AAC and Aparan AARC for the provided support and carried out activities. He greatly appreciated the work of AAC lawyers who did not lose hope from the long going process and achieved successful resolution.
