Mr. V.E. had applied to Yerevan AAC on 2 June 2011 and informed that the investigator A.A of Police Station of Nor Nork of Yerevan had taken his passport on 11 May and was keeping it illegally. V.E. wanted to sell his flat and had borrowed 2000 USD from his neighbor Zh.A. to use this sum for this purpose. On 5 May 2011, Zh.A. had applied to Police Station of Nor Nork of Yerevan and accused him in fraud. In the period of 11 May through 2 June no criminal case was initiated based on the prepared materials on the fact (it is due to mention that 23 days had passed instead of the 10 days since the receipt of the statement, as provided in Article 180 of the RA Criminal Procedure Code), V.E was not provided procedural status and his passport was kept in the police station illegally. In result the citizen was deprived of his right to execute his legal rights and freedoms.
Investigator A.A. intentionally committed actions, which were obviously beyond the scope of his authorities and infringed V.E.’s rights and legal interests.
Considering this fact, Yerevan AAC prepared and on 07.06.2011 sent a notice to the Chief of the RA Police. On 09.07.2011 Mr. E.GH., Acting Head of Staff of the RA Police in his reply informed that service investigation was initiated on the fact of taking the citizen’s passport by the Police Officer A.A. The notice also informed that the conclusion was sent to Yerevan Police Administration for consideration of the disciplinary responsibility issue of the officer. Yerevan AAC did not receive any further information on the issue.
On 15 December 2011 Yerevan AAC sent a notice to the Head of Yerevan Police Administration with request to provide information on the results of consideration of the disciplinary responsibility issue of A.A.
Five days later, on 22 December 2011, we received a reply from the Head of Yerevan Police Administration informing that based on the conclusion of the service investigation on the fact of taking and keeping the citizen’s passport by the police officer, and on the basis of violation of the requirement of the corresponding decision of the RA Government, as well as in compliance with Article 42(1) of the RA Law on the Service in Police, Captain A.A., inspector of investigative department of Nor Nork Department of Police, received “reprimand” on the order N 610-A of 21.07.2011 of the Head of Yerevan Police Administration.
