A few minutes ago, The European Court of Human Rights issued a decision on the case “ Saghateliyan v. Armenia”, which recognizes that the Republic of Armenia has violated the person’s right to a fair trial as defined in Article 6 of the Convention.
According to the materials of the case, Anahit Saghatelyan, the applicant, worked in the Gegharkunik Court of First Instance. In 1997, 2000 and 2001, disciplinary sanctions were applied against her and on 30 April, 2004, she was dismissed of the Judge’s post according to the decree of the RA President.
Anahit Saghatelyan disputed the legality of the RA President’s decree on dismissal in Armenian courts, but hasn’t achieved any results.
The ECHR, recognizing her violated rights, has decided to establish as compensation for non-pecuniary damage a sum of 3,600 Euros and acompensation for pecuniary damage a sum of 1300 Euro. The state is obliged to compensate the sum within 3 months after the decision enters into force.
Notably, A. Ghazaryan and M. Danielyan were the representatives of the former judge.
