Most of the drivers have expressed their dissatisfaction about the place of the sign limiting the traffic speed up to 40km/ph in Nairi Zaryan Street. The sign is placed so, that the drivers can hardly see it when driving from Komitas Avenue to Nairi Zaryan Street.
Advocate Vahe Astvatsatryan, annulled the TP’s decision on imposing administrative penalty, according to which the infringement of the speed limit of 40 km/ph by 8 km/ph was recorded by the devise installed in Naoiri Zaryan Street.
According to the advocate the sign is not visible for the drivers who drive from Komitas Avenue to Nairi Zaryan Street, as they lack an objective opportunity to be duly notified about the allowed maximum speed limit of 40 km/ph there.
In addition, the distance of visibility of the sign must be at least 100 meters (Article 30 of Appendix 3 of 26 October 2006 Decision 1699-N of the RA Government) and the signs must be situated so that they do not disturb driving traffic means.
The court satisfied the claim, recognized the administrative act void, and exacted 4000 AMD from the RA Traffic Police as a state duty in favor of the State Budget.
According to V. Astvatsatryan the drivers exceeded the speed limit of 40km/ph in Nairi Zaryan Street can litigate the administrative acts of the TP referring to the reasoning of the court in the decision on the case VD/0002/05/15 as a legal precedent.
