Chocolate — A Clear and Present Danger?

The American Environmental Safety Institute has filed a lawsuit accusing chocolate makers of violating California’s Proposition 65 requiring manufacturers to warn consumers of products containing dangerous chemicals. The group alleges that chocolate contains “potentially dangerous levels of lead and cadmium,” which can “retard mental development in children younger than six and … harm the fetuses of pregnant women.” The California Governor’s advisory board and other scientists have determined that chocolate products are safe. Michele Corash, attorney for the chocolate companies, asserts that this is nothing more than “shameless scare tactics” by the group. The institute’s lawsuit seeks, in addition to warning labels on all chocolate products, restitution for consumers and civil penalties as high as $2,500 per day per violation.
