On August 6, at the Court of General Jurisdiction of Shirak Marz the trial the case of the accident of “Kamaz” and “Gazel” vehicles went on. The examination started with the Prosecutor A. Avetisyan’s accusative speech.
He represented the details happened on November 10, 2014 concerning them as the Criminal Code of the RA Article 242 Part 3. He referred to the testimonies of the injured party and witnesses given during the preliminary investigation and trial. He also spoke about the aggravating and mitigating circumstances of the accused. Then he mentioned that there were no mitigating circumstances; mitigating circumstance considers being positive and good characteristics, having minor and invalid child under 14 years-old. In the end of his accusative speech he pleaded M. Vardanyan completely guilty and asked to sentence him to 9 years imprisonment by depriving driving license for 3 years. The accusative speech of the Prosecutor lasted 2 hours.
Then the representative of the injured party Hasmik Hovhannisyan, R. Movsisyan also had speech.
The Counsel Liana Balyan’s address was short because the Prosecutor had already represented the whole case. L. Balyan mentioned that there are flaws in the expertise and also some traffic signs were absent and that is why the driver of “Gazel” violated traffic rules. In the end, she interceded for mercy with the judge.
The accused Manvel Vardanyan mentioned in his speech: “Initially, I partly admit my guilt that I did not yield the right-of-way and repeated many times that the sign “Stop” is replaced in a wrong place because the view cannot be seen.
After that the assignees of the injured parties had remarks; they resented because the accused did not admit his guilt. L. Balyan presented that the case of the attack at her by the Director of “Trans Akntart” LLC Anahit Khalatyan; confrontation of that case started 30 minutes lateness. Besides, she has reason to suspect that she had pressure on the injured party for giving false testimony.
In his last plea the accused M. Vardanyan mentioned that he was not ready and asked for giving him 3 days. The judge allowed the application and apponited the next trial on August11, 2015.
