At the today trial of 30-year-old R. who is accused of hooliganism with weapon enforcement the witnesses and the legal representative of the injured person-the teenager’s father did not appear at the court.
The court (presided by the Judge Davit Harutyunyan) presented to the both sides the police notification why the taking to the court of injured party’s legal representative and 4 witnesses is not applied. The thing is that either they are not living the place mentioned or registered there.
The accused party reported that the court should give the police additional 20 days for that people to appear in the court. But the Defense Inessa Petrosyan mentioned that police did everything to find them and it is obvious that they are hiding from the examination.
Inessa Petrosyan said: “The trials are postponed because of dishonest witnesses. The accused party presents them and they must decide to renounce them; there is no other way for it.”
However, the court decided to announce the testimony of the preliminary investigation but would come to their final conclusion only at the end of the judicial act.
According to the preliminary testimony of the legal representative of the injured party Armen Abroyan, on July 7, 2014 he was guest at his friend’s house and was playing cards with neighbors; when they wanted to leave the second floor neighbor screamed, “Go, go, ya man.” They tried to understand what the reason was of this, he continued, “Go, go, I would throw a grenade on you.” Then the shot was heard and he saw his teenage boy injured, he took him and ran to the entrance. He also mentioned that he had never committed blasphemy, only after his son was injured.
The Defense reported that Abroyan testified in Russian, his testimony was translated but the translator was not qualified and there were misspells in the translation.
The content of the testimony is also controversial; it is obviously seen in the video that he did not take his son and ran to the entrance.
The witnesses’ testimonies are also controversial; the Defense mentioned that because of the witnesses’ absence there is no opportunity to ask some questions which will clarify the situation, especially at which moment the boy got the injury.
There is also perjured information in the witness Armen Yepremyan’s testimony; he reported that he did not know the accused R., however, the accused insisted that they even had private conversation in the yard about the late gatherings and making noise at a very late time.
According to the Defense, the witnesses’ testimonies are also taken by the contravention; especially the fact that as one witness said they all were taken to police department, they all were examined together, they stayed there all night and they all were examined as the suspects.
After the testimonies announcement the court appointed next trial on August 7.
According to the accusation, in the unknown period R. illegally obtained and kept in his rented apartment sport and hunting gun bullets with 5.6 mm caliper made by craftsmanship and provided for shooting, a threaded gun and ammunition, 29 bullets.
Then on 7 July, 2014, at 23:30 o’clock the accused started fighting with 4 men who were playing cards in the arbor, during which he obviously treated them and other residents of the building with irreverent behavior and shot several times with his gun from the window of his apartment, cruelly and intentionally breaking the rest of the people and public order for about 20 minutes. As a result he intentionally damaged Grigor Abroyan’s health, inflicting slight injuries.
