Artur Ghambaryan, the deputy director of the RA Investigative Committee has posted the following statement on his Facebook page:
“Constitutional thesis 1: The power in the Republic of Armenia, including the judicial branch, belongs to people.
Constitutional thesis 2: People exercise state and judicial power (have to exercise) by direct (elections and referendum) and indirect ways (state organs or officials).
Constitutional-legal thesis 3: People directly participate in the formation of the legislative and executive power (broadly speaking, including the RA President), or at least their implementation using different legal and organizational methods.
So the question is, whether people have the constitutional right to somehow directly participate in the formation of the legal power (the election of judges) or at least in the implementation of justice (the panel). What are we afraid of?”
