Advantages and Disadvantages of Arbitration. During the two days seminar the German expert lawyers shall discuss this issue with the Armenian lawyers.
The seminar is initiated and organized by German Foundation for International Legal Cooperation (IRZ) in cooperation with the Armenian Young Lawyers Association.
“Arbitration is when the parties exclude the court of general jurisdiction and apply to arbitration court for the solution of their differences in essence. Simply, when signing an agreement there must be a reservation for arbitration court or the parties should sign a corresponding agreement during the course,” Artak Mikaelyan, Arbiter of the Permanent Arbitration Court of the Chamber of Commerce and Industry of the RA said.
According to Mr. Mikaelyan, this option for conflict resolution is more expensive than applying to the court. Yet the Arbitration Court solves the issue (the dispute) during 4 (four) months maximum, whereas the case investigation in the court may last for years.
Permanent Arbitration Court of the Chamber of Commerce and Industry of the RA has heard 11-12 cases since 2007
“The reason of such small amount of cases, in particular is unawareness of the business environment and we have much work to do in this respect,” Mr. Armen Voskanyan, Secretary General of the Permanent Arbitration Court, Head of the Legal Department of Chamber of Commerce and Industry of the Republic of Armenia.
It is due to mention that German Foundation for International Legal Cooperation (IRZ), permanently organize training courses for the lawyers in the scope of cooperation with the Armenian Young Lawyers Association
