An Anti-Corruption Court of Appeal will be established: It will have 12 judges

The Ministry of Justice has presented a new draft of amendments and additions to the Judicial Code for public discussion. According to the developer of the project, it stems from the need to ensure a more specialized and effective examination of anti-corruption cases in the Court of Appeal.

The purpose of the draft is to ensure the re-examination of judicial acts made in cases related to anti-corruption civil and corruption crimes by a specialized Anti-Corruption Court of Appeal.

“As a result of the adoption of the draft, the Anti-Corruption Court of Appeal will be established, which will carry out the review of judicial acts made in cases related to anti-corruption civil and corruption crimes in the order of re-examination. The court will consist of at least 12 judges, of whom at least 6 will deal with cases related to corruption crimes, and at least 6 will deal with appeals against judicial acts issued in anti-corruption civil cases. In other words, in the Anti-Corruption Court of Appeal, the cases of review of acts made in cases of corruption crimes will be distributed only among judges specializing in the examination of corruption crimes, and the cases of review of acts made in anti-corruption civil cases will be distributed only among judges specializing in the examination of civil cases of anti-corruption.

Thus, as a result of the adoption of the draft, the Criminal Court of Appeal and Civil Court of Appeal will stop examining the judicial acts subject to appeal in corruption crimes and anti-corruption civil cases, respectively.

The draft also proposes adding an anti-corruption section to the list of candidates for promotion to the Court of Appeal, providing that the sub-sections of investigating corruption crimes and investigating anti-corruption civil cases will be included in the anti-corruption specialization section.
