Onik Gasparyan is formally the Chief of General Staff of the Armed Forces: Gevorg Gyozalyan

Iravaba.net spoke with lawyer Gevorg Gyozalyan about fictitious acts of positive or negative nature adopted in silence (inaction).

In the mentioned context, the issue related to Onik Gasparyan was also referred to.

It should be reminded that Onik Gasparyan’s lawyer Arthur Hovhannisyan filed a lawsuit in the RA Administrative Court against the President of the Republic of Armenia Armen Sarkissian and the Prime Minister of the Republic of Armenia Nikol Pashinyan, asking to recognize the dismissal of the Chief of the General Staff, Colonel-General Onik Gasparyan, asking to annul the decree on dismissal of the Chief of the General Staff of the Armed Forces, Colonel-General Onik Gasparyan, which was adopted by force of law, and which was confirmed by the 10 March, 2021 statement of the Prime Minister, on  declaring that Onik Gasparyan was legally dismissed from the post of Chief of the General Staff of the RA Armed Forces.

The RA Government issued a statement on 22 March, noting that Artak Davtyan is legally appointed to the post of Chief of the General Staff of the RA Armed Forces, while a few days ago the RA Administrative Court, chaired by Judge Mher Petrosyan, upheld the lawsuit in the case of Chief of General Staff Onik Gasparyan and met the lawyer’s motion to apply means of securing the claim, which demanded to suspend Onik Gasparyan’s dismissal until the final judicial act on the case is made.

Notably after the decision of the administrative court, the Prime Minister’s Office issued a statement claiming that Onik Gasparyan was relieved of the post of Chief of General Staff of the RA Armed Forces.

Back on 25 February, Nikol Pashnyan announced live on Facebook that he had made a decision to dismiss the Chief of the General Staff of the RA Armed Forces Onik Gasparyan. Earlier on the same day, the RA Armed Forces demanded the resignation of the RA Prime Minister and the Government.

Noted that Onik Gasparyan sent an application to the RA General Prosecutor’s Office. He demands to initiate a criminal case against the RA Prime Minister Nikol Pashinyan and the Minister of Defense Vagharshak Harutyunyan, according to the Article 308, Point 2 of the RA Criminal Code, that is, the abuse of official authority, which negligently caused grave consequences.
