The ECtHR has decided to apply an Interim Measure

The European Court of Human Rights, on the basis of the application of the Government of the Republic of Armenia on the application of an interim measure, made a decision on 29 September of this year to apply it. This was reported by the office of the RA representative in the ECtHR.

In particular, taking into account the fact that the situation may lead to serious violations of the Convention, the ECtHR, composed of a Chamber of 7 judges, decided to apply Rule 39 of the Rules of Court. In order to prevent such violations, as in accordance with Rule 39, the ECtHR calls on Azerbaijan and Armenia to refrain from any measures, in particular hostilities, that could lead to violations of the Convention’s civil rights, including endangering their lives and health. The ECtHR also calls on Azerbaijan and Armenia to fulfill their Convention obligations, in particular Article 2 (right to life) and Article 3 (prohibition of torture and inhuman or degrading treatment or punishment)..

“Both High Contracting Parties shall, as soon as possible, submit information on the fulfillment of their obligations to the European Court,” the statement said.

Notably, the Republic of Armenia applied to the European Court of Human Rights with a demand to apply an intermediate measure against Azerbaijan, ie to force Azerbaijan to stop bombing civilian objects along the entire line of contact between the Republic of Armenia and the Artsakh Republic, to force Azerbaijan to refrain from non-selective offensive operations, to force Azerbaijan to refrain from targeting citizens, civilian objects and settlements.
