The President of the Chamber of Advocates Ara Zohrabyan issued a statement, which reads:
“Everyone has the right to fresh air:
A group of lawyers submitted a petition to the Government of the Republic of Armenia proposing:
– Eliminate restrictions by the Commandant on wearing a mask by a single person in open public areas, as well as on wearing a mask by family members in a vehicle.
Excerpt from the text: In this case, the person’s right to breathe is restricted so that the person does not infect another person or be infected by another person.
The logic of this intervention does not change when the Commandant requires a masked person to walk alone in the open air. It turns out that a person cannot infect another person or be infected by him, but must breathe in a mask.
Forcing family members to wear a mask in a vehicle also does not stand up to criticism, as family members can communicate with each other in their apartment without a mask.
The mere argument that in this way the state can more effectively control the transportation of non-family members by transport does not stand up to criticism. “It turns out that the state deprives a person of the right to breathe in order to facilitate its control, which does not directly correspond to the intervention test.”
