“Vernatun” Public-Political Club has issued a statement on the amendment to the Constitutional Law on Constitutional Court, which states:

“The National Assembly has adopted the RA Law “On Amendments to the Constitutional Law “On the Constitutional Court”, known in the public as the law on “bribing CC judges by law” or the law on privatizing the CC by the Prime Minister.

Only the ruling “My Step” faction voted for the law, that is, this important document was adopted with the utter absence of parliamentary consensus and the dictate of the executive branch. This is another step toward getting rid of independent judges who do not obey them.

Although the adoption or discussion of controversial laws by the parliamentary majority has recently become a dangerous rule, we still find that the CC law poses the greatest risks. This is an interference with the work of the Constitutional Court, aimed at abolishing the constitutional justice by adopting the CC powers and threatening the constitutional order of the Republic of Armenia. On the basis of false justifications, the change of the political authorities is based on the anti-constitutional phenomenon of the change of the judicial power.

The Club considers this law to be inconsistent with the letter and spirit of the Constitution, since the mechanisms of separation and balancing of powers are violated, and an attempt is made to establish sovereignty contrary to the rule of law and democracy. The law clearly contradicts to Articles 1, 3, 4, 61, 63, 78 and 213 of the RA Constitution.

This document aimed at satisfying the wishes of one person at the expense of taxpayers is now in the domain of the President of the Republic, and it is his sole responsibility to suspend the process of adopting the law by applying to the Constitutional Court to determine the conformity of the law with the Constitution.

By signing the law, the President of the Republic will personally assume full responsibility for the adoption and consequences of this anti-constitutional and anti-democratic law, as pursuant to the Constitution – it is the function of the President to observe the Constitution.

Even if the President of the Republic signs this law, it will still be recognized as unconstitutional sooner or later, but the damage will be irreversible. It is time to realize the personal responsibility of the head of state for the present and the future of our country.”
