The Employees who protested against the Compulsory Accumulative Component, require restoring them in their Work Places

Today the Court of General Jurisdiction of Arabkir and Kanaker-Zeytun Administrative Districts of Yerevan, under presidency of Judge Simizar Hovsepyan considers the case of three former employees of Karen Demirchyan Yerevan Metro CJSC, Sevak Hovhannisyan, Andranik Gevorgyan and Gagik Galstyan, who were protesting against the compulsory accumulative component; require restoring them in their work places.

During the preparatory session, Lawyer of the “Fund Against Violation of Law” NGO Kristina Gevorgyan, representative of the plaintiffs, presented the claim to the court and demanded to annul the orders of their dismissal, to restore them in their work place and to pay for the whole period of the forced outage.

The respondent’s representative, Artak Yeremyan, Head of the Legal department of Karen Demirchyan Yerevan Metro CJSC, mentioned that the claimant had failed to meet their labor responsibilities properly, and that was the ground for their dismissal. He also mentioned as a violation the fact that they had allowed to enter the machine room persons who were not authorized to be there.

“Plaintiff Galstyan during his shift had violated the exploitation rules. What violation was it?” the judge asked after reading the response to the claim, which the respondent had submitted.

Artak Yeremyan said that the violation was failure to make a corresponding record in the journal.

Claimant Andranik Gevorgyan said that in addition to the log entries in the journal, audio records are made as well. In other words even if they do not make a record at that moment, however the voice is recorded.

The Jude demanded from the respondent to provide that audio record. Artak Yeremyan noted that they would provide it if it had been recorded.

Claimant Andranik Gevorgyan also said that there were other persons in the moving ramp cabin because a breakdown had taken place on that day, and they had come to repair the break. They were authorized to be in the machine room.

After another preliminary court session the court will proceed to the court hearing phase. The next court session will take place on 31 March.
