The SJC rejected the petition of the Minister of Justice

Today, on 26 January, the Supreme Judicial Council published the decision regarding the petitions of the Minister of Justice Grigor Minasyan to subject Eduard Amalyan, judge of the Yerevan Court of General Jurisdiction, to disciplinary responsibility.

The Council rejected the petition submitted by the Ministry.

Let’s remind that the Ministry of Justice demanded to be subject Judge Eduard Amalyan to disciplinary responsibility for violation of deadlines.

In particular, according to the petition submitted by the Ministry of Justice of the Republic of Armenia, the judge allegedly allowed violations of the requirements of the norms of procedural law, Article 125, Part 3, Article 166, Part 1 of the Code of Civil Procedure, that is, the decision to admit the lawsuit into proceedings , provided the copy of the claim and the documents attached to it to the defendant before the execution of the court’s decision to apply a security measure for the claim, further the above-mentioned documents were provided to the defendants about 7 months after the specified time, due to which a preliminary court session was scheduled and convened late due to the specified period, the violations committed under such conditions also led to the violation of the rules of conduct of judges defined by Article 69, Part 1, Clause 1 and Article 70, Part 2, Clause 6 of the Constitutional Law “Judicial Code of the Republic of Armenia”.
