Vardan Amaryan was fined AMD 20.000 by the Traffic Police for violating prohibition sign in Teryan-Koryun crossroad.
Applying to Administrative Court he reported that flashing green signal of the light allows the traffic and according to it, the period of the maneuver is going to end and soon the prohibition sign will turn on. He drove to Teryan-Koryun crossroad while the green light was flashing which allows further traffic, and it means that there is no traffic violation.
The proof of the violation was sent to the Judge by the video and the respondent mentioned that applicant’s claims that he crossed the line during the green light are baseless because it can be clearly seen on the video how the green light turned down and there was no shimmer anymore: the applicant’s vehicle appears at the shot in 10:57:35 second and crossed the stop line in 10:57:38 second which means after 4 seconds when the green light turned down. On the bases of the given facts the respondent asked the Court to reject the suit.
The Court decided that the violation shown on the video evokes suspicion and it is clearly seen on the video that the applicant did not violated traffic rule and did not pass on the red light as well.
Considering all the evidence, the Court decided to approve Vardan Amaryan’s suit and invalidated the decisions of the RA Traffic Police.
