The victim refusing to give a testimony incurred a criminal blame

RA Special Investigatory Service informs that Armen Tamaryan, detained on suspicion of the attempt to intentionally destroy or damage other’s property, on 26 October 2014 told the employees of the establishment where the arrested are kept, that he had been detained on suspicion of committing a crime at Bazum Department of the Police, then he had incurred violence and then had been arrested and moved to the establishment where the arrested are kept.
At RA Special Investigatory Service a criminal case in relation of this incident was initiated on Part 2 of Article 309 of RA Criminal Code. During the preliminary investigation Armen Tamaryan refused to give a testimony as a witness, although he had been warned about criminal blame for refusing to give a testimony foreseen by Article 339 of RA Criminal Code. Further on, he again refused to give a testimony as a victim during the interrogation.
As a result, the proceeding on the criminal case initiated on malfeasance combined with violence was dismissed. A criminal case in relation with Armen Tamaryan’s refusal to give testimonies was initiated on Point 1 of Article 339 of RA Criminal Code. The Preliminary investigation of this case was over. The case with condemnatory inference was handed to the prosecutor carrying out procedural supervision, for verifying and sending it to the court.
Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
