The preliminary investigation of the criminal case initiated on using violence against the investigator of the RA Special Investigation Service in a penitentiary was completed in Yerevan Investigative Department of the Investigative Committee of RA.

Through the investigation it was found out that on June 02, 2015 at about 15.00 o’clock a confrontation between the prisoner of “Nubarashen” penitentiary of the RA Ministry of Justice and the head of Municipal Police Station of Ashtarak was conducted by the investigator of RA Special Investigatory Service in the room N 3 of the same penitentiary, designed for investigatory actions. While conducting the investigatory action the prisoner scolded the police employees.

During preliminary investigation sufficient evidence were obtained on the allegation that the prisoner did not obey the investigator’s demands to stop scolding, he punched at the right part of the latter’s face thus using violence not dangerous for life and health against a representative of authorities concerned with performance of his official duties.

On the bases of the evidence obtained during pretrial proceeding the prisoner of “Nubarashen” penitentiary of RA Ministry of Justice was charged according to Article 316, Part 1 of the of RA Criminal Code.

The criminal case with the bill of indictment was sent to the prosecutor supervising the legality of preliminary investigation.

Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
