“A good document has been created, many provisions are useful, but it also contains some bombs, I think the committee has also paid attention to these very bombs, which can eliminate the entire project”:- said attorney Yervand Varosyan speaking about the new draft Criminal procedure.
However, he raised the following question: ” The current Code has operated, if not, you may change the code thousand times but it won’t bring a sense. The practice of law does not apply the law fully”:- he said.
We spoke with the attorney about the changes in the Criminal Code, in particular about the sanctions policy.
“From the point of view of the state it is clear that the severity of the punishment had never has any effect. Everybody understands that the avoider of responsibility changes something in this or that state. We will not have anything no matter how strict it is”:- said the lawyer.
According to him there are dual approaches in the current Criminal Code: “That is, there are types of crime, where we can discuss the issue of toughening, and there are economic, property crimes where the general principle of punishment needs to be changed, for example imprisonment may be replaced by property obligations. If a person has committed an economic crime we can hit his pocket. This will be more visible for him, as well as the state will benefit from it”:-concluded Mr. Varosyan.
