From the very beginning there was an Objective to take Permyakov under the RF jurisdiction, and do not surrender him to Armenia: Advocate

“Under the requirements of article 4 of the Agreement Regulating the Relations Between the Republic of Armenia and the Russian Federation concerning the Russian Military Base in the Territory of the Republic of Armenia, the Armenian side shall carry out the investigation of the case on the fact of 12 January murder in Gyumri. This is definite and there is nothing to discuss anything in this regard,” advocate Yervand Varosyan said in the interview to iravaban.net.

The lawyer believes that the Russian border guards after the arrest of the wanted person Valeri Peryakov should have been surrendered to Armenia as he was wanted by the RA Law Enforcement Bodies.

“The representatives of a foreign country are not entitled to decide whether to surrender the wanted fugitive in the RA or to move him to another place.As you see the Russian side’s actions from the very beginning showed what they were going to do. If they had launched a criminal case on the fact of desertion only, according to the agreement, it is reserved for them. However but before the finding Pernyakov the Russian part initiated a criminal proceedings on the fact of the murder as well, though they did not have such right. In addition, the Russians launched search activities in Shirak marz of Armenia. These both circumstances show that it was originally intended to take Permyakov under the Russian jurisdiction, and not surrender him to Armenia,” the advocate emphasized.

Today, the Investigative Committee of the RA issued a statement about the decision to involve Valerie Permyakovin as the accused, but there were no word about the charges against him.

Referring to this statement the Advocate said, “Decision to involve as an accused was made, but I do not think that there might be a charge mainly based on the absence of possibility. In order to file an indictment, the corresponding official of the Investigation Committee of the RA should come and  file an indictment, explain the rights and responsibilities, etc. But in fact that person was in the territory of the Russian military base.”

In conclusion the Advocate said, “From the very beginning all this process was beyond the legal aspect.  From the very moment when the Russian side initiated a criminal case on the fact, where they were not authorized to initiate a criminal case and carry out the trial, just starting from that moment everything appeared out of the legal aspect.”
