European Court of Human Rights took decisions on two cases of the RA citizens. One decision refers to the case of freedom fighter Vardan Malkhasyan. The latter was arrested in December 2006 in compliance to Article 301 of the RA Criminal Code, “Public calls for changing the constitutional order of the Republic of Armenia by force” and sentenced to a two years term. European Court of Human Rights observed violation of the requirement of Article 5 (Right to Liberty and Security) of the European Convention on Human Rights in Malkhansyan’s case. The Court decided to exact 4.5 thousand EUROs from the Government of the Republic of Armenia as redress for moral damages caused to Malkhasyan.
The second case, which ECHR met, was Kamo Piruzyan’s claim. Here the Court considered that violation of Article 5 (Right to liberty and security) of the European Convention on Human Rights had taken place as well. In particular violation of the requirements of Clauses 1, 3 and 4 of Article 5 of the Convention were recorded. Violation of Article 3 of the Convention (Prohibition of Torture) was recorded as well. The Court requested 8.000 EUROs as compensation of moral damages from the RA Government.
Kamo Piruzyan was charged for organization of armed brigandage and attempt of murder in 2006. The Court had extended the term of Piruzyan’s arrest for several times, which was considered as violation of the requirements of Article 5 of the Convention. Piruzyan was absolved in 2007.
