Judge Ylena Arakelyan published the decision regarding the motion to withdraw.
Earlier we reported that Ara Hakobyan, Director of “Kecharis Hotel” Limited Liability Company, filed a lawsuit against the Cadastre Committee, demanding to declare the state registration of 10 December, 2021 for the real estate located at 14 Aivazovsky Street invalid and oblige to register the ownership right of the plaintiff to the same address. “Arndane” Company, which is involved in the case as a 3rd party, submitted a challenge petition to the presiding judge.
According to the representative of the company, Nerses Aghababyan, the plaintiff, Ara Hakobyan, is related to the former head of the Compulsory Enforcement Office, Mihran Poghosyan, who in turn is the cousin of judge Ani Harutyunyan. According to the lawyer, Ani Harutyunyan and presiding judge Yelena Arakelyan are friends.
According to Iravaban.net , the court rejected the submitted challenge petition.
Ylena Arakelyan noted that the “Arndane” Ccompany had not provided sufficient evidence to consider the fact that Ara Hakobyan and Mihran Poghosyan were connected.
“…Although the above is sufficient in itself to reject the submitted petition, until the fact that Ara Hakobyan and Mihran Poghosyan are related is not confirmed, the relationship between the plaintiff in this administrative case and Ani Harutyunyan, the judge of the Administrative Court, is not clear, however, I consider it necessary to address also about the information received from the mass media, which is the basis of the petition by the representative of the 3rd person, that the judges of the Administrative Court, Yelena Arakelyan and Ani Harutyunyan, are friends,” the judge noted and added that they are in a partnership relationship.
The decision states that there is no basis for recusal, the petition was rejected.
