30 MPs participated in the closed vote of the draft decision presented to the NA “Armenia” Faction of the National Assembly on the termination of powers of the judge of the CC Seda Safaryan.
The draft received 30 “for” and 0 “against” votes, it was not adopted. Thus, the National Assembly will not apply to the Constitutional Court on the issue of terminating the powers of Seda Safaryan.
The parliamentary majority announced that they would not participate in the vote.
Notably, the basis for the presentation of the draft was the joint application of lawyers Arsen Babayan and Sos Hakobyan to the NA factions.
“…There is a reasonable assumption that Seda Safaryan has violated the requirements of incompatibility established for a judge of the Constitutional Court, under which conditions the National Assembly is authorized to apply to the Constitutional Court with an application regarding the termination of the judge’s powers,” the justification states.
It is stated in the draft that Safaryan also engaged in business activities while holding the position of judge.
Judge of the Constitutional Court Seda Safaryan addressed the issue in an interview with Iravaban.net on 26 January.
“There is no such problem that they try to light a fire and warm their hands. It is a small issue that has been discussed and I don’t think it can be defined as “implementation of representation”. Maybe they have questions to address to the court, they don’t address it to the court, they address it to me,” Safaryan noted.
