The Government has approved the Draft Law “On Amendments and Additions to the Law on the Anti-Corruption Committee”, the adoption of which is conditioned by the need to have more comprehensive legal regulations regarding the implementation of disciplinary proceedings in the Anti-Corruption Committee.

According to the justification, the formation of the disciplinary system plays a key role in strengthening integrity in the sphere of public service, and from that point of view, it is important to ensure a proper and proportionate response to all the violations that occur.

Accordingly, it is necessary to form a perception and confidence that the rules of conduct are applied fairly, objectively and in timely manner, which can be ensured by defining an effective and efficient mechanism for the implementation of disciplinary proceedings.

According to the draft, it is proposed to complement relevant regulations in order to create structures for the formation of the Disciplinary Commission. In particular, it is proposed to form a commission consisting of 8 members in the Committee. The members of the commission will be appointed for a period of 3 years, and the term of office of the chairman will be 1 year.

The draft also specifies the procedures for applying disciplinary measures. It is envisaged that the official investigation carried out against the employee of the committee has two stages: preliminary investigation and disciplinary proceedings. It is recommended to establish clear deadlines for the implementation of disciplinary proceedings. Guarantees were also defined in terms of ensuring the rights of the committee’s employees. The employee shall have the right to give an explanation regarding the disciplinary proceedings initiated against him, to receive legal assistance, including acting through a representative.
