Judge Arghamanyan stated in his decision that Bakhshiyan acted independently, impartially and in good faith: Advocate

Advocate Yerem Sargsyan referred to the case of Boris Bakhshiyan, noting:

  1. It was mentioned in Boris Bakhshiyan’s accusation that he had made an EXPRESSLY ILLEGAL JUDICIAL ACT regarding the arrest of Nver Mkrtchyan.
  2. In the motion for arrest, the prosecution stated that the objective side of the crime of the criminal act charged against Bakhshiyan was manifested by making an EXPRESSLY ILLEGAL JUDICIAL ACT.
  3. Judge Arghamanyan stated in his decision that the judicial act made by Bakhshiyan is LEGAL. No one, including the investigator and the prosecutor, has the right to even doubt its legality.
  4. The prosecutor’s office did not file an appeal in this regard.
  5. Judge Arghamanyan stated in his decision that Bakhshiyan acted independently, impartially and conscientiously.

But all the same, Bakhshiyan has been in custody for 44 days already.

It should be reminded that the Court of General Jurisdiction of the city of Yerevan, chaired by Judge Davit Arghamanyan, had made a decision to detain Judge Boris Bakhshiyan of the Court of General Jurisdiction of Syunik Region. He is accused of apparently illegally detaining a person, which caused severe repercussions.

On 31 January, the SJC unanimously decided to grant the motions to agree to prosecute Boris Bakhshiyan and to grant the judge deprivation of liberty.
