Judge Hrayr Tovmasyan of the Constitutional Court stopped his participation in the working session of the Constitutional Court, when  only one candidate for the presidency of the Constitutional Court, Yervand Khundkaryan was left.

Hrayr Tovmasyan, the President of the Constitutional Court said this in a conversation with journalists and added that he had the impression that all this was directed and conditioned. According to him, when nominating the candidacy of Judge Ashot Khachatryan, he took into account 3 factors.

“I said in the morning that I will take into account three main factors when nominating candidates. The first was the human qualities that could create those relationships. I had the opportunity to say above that it is very important for the president of the court to see things that other judges will not see, from mood swings to health problems. Judge Khachatryan is the most experienced. I not only nominated Mr. Khachatryan, but I referred to each or almost everyone, I said why I do not nominate them. Mr. Khachatryan is the most experienced, the oldest, a doctor of sciences and has certain managerial skills. Mr. Khachatryan has 2 years left in office, this would be a unique transition period, so that the rest would know each other better and not rely on their previous experience when making a choice. In fact, the 4 judges are new to the Constitutional Court, who do not know each other or have not been in that atmosphere. “The functions of the President are not significant in this regard and those circumstances must be taken into account,” he said.

The judge of the Constitutional Court also referred to the issue of the legitimacy of the judges of the Constitutional Court. “From the beginning, I have expressed my position in terms of the lack of legitimacy of each of the judges and to clearly fix each of them, who has a degree of legitimacy. The nomination of Mr. Khachatryan was also conditioned by the fact that he was one of the 4 judges who has no lack of legitimacy.”
