What happens when the Individual submits the Claim to a Wrong Court?

Due to the Rules of Jurisdiction the court must consider in substance the case accepted to its proceeding, notwithstanding the fact if later this case shall fall under jurisdiction another court.

 

The court transfers the case to the jurisdiction of another court when:

 

1. If the court determines that the case was admitted to its proceeding in violation of the rules of jurisdiction.

 

2. In case of impossibility to determine the case in that court.

 

The decision on the alteration of the jurisdiction is passed in respective cases by the court which considers the case.

The case forwarded from a court of one jurisdiction to the other shall be determined by the court which received the case.
